Harper Grey Managing Partner, Jonathan Meadows, was quoted in a recent Lawyer’s Daily article. The article discusses two recent dismissed appeals by the Ontario Court of Appeal from two insurers over coverage to construction companies that were sued over their work on a condominium apartment tower project. In this case, the two insurance companies in question were required to provide coverage to companies that had been involved to varying degrees in the condominium tower project.
Jonathan commented on the decision, stating “It is another instance where an insurer has been unsuccessful in characterizing a claim as solely about construction defects which are not covered where the pleadings allow for the mere possibility that the claim is for covered property damage.”
